Conveyancing FAQ’s
Expert answers to common injury claim questions
What is conveyancing?
Conveyancing is the legal process involved in buying or selling a property. It includes investigating legal title, carrying out searches, reviewing contracts, liaising with lenders, and ensuring the property is properly transferred in accordance with Northern Ireland property law.
Do I need a solicitor for conveyancing in Northern Ireland?
Yes. In Northern Ireland, conveyancing is usually carried out by a solicitor to ensure the legal title is sound and that your interests are fully protected. A solicitor will also deal with mortgage requirements and registration with the Land Registry.
How long does conveyancing take in Northern Ireland?
Timescales can vary depending on the property, whether the title is registered, and whether there is a chain involved. While some transactions complete within a number of weeks, others may take longer. We will keep you informed throughout and work to progress matters as efficiently as possible.
How much does conveyancing cost?
Conveyancing costs depend on factors such as the value of the property, whether it is registered land, and the complexity of the transaction. We will provide clear information on legal fees and outlays at the outset so you know what to expect.
Can you act for my mortgage lender?
In most cases, yes. We regularly act for both buyers and their mortgage lenders during conveyancing transactions in Northern Ireland, ensuring all lender requirements are met as part of the process.
What happens on completion day?
On completion day, the balance of the purchase price is transferred, ownership of the property legally passes to the buyer, and keys are usually released. We will confirm once completion has taken place and deal with any post-completion formalities.
What is registered and unregistered land?
Registered land has its ownership recorded with the Land Registry of Northern Ireland. Unregistered land has not yet been registered and may require additional investigation of title deeds. We will advise you on the status of the property and any implications for your transaction.
When do I pay the deposit?
When buying a property, a deposit is usually paid when contracts are exchanged. The amount and timing can vary depending on the transaction and lender requirements, and we will guide you through this process.
